Terms of use

These terms are an agreement between you and [TODO: legal name], [TODO: country] (“we”, “us”) about the Silo app for iOS and Android. Please read them with our Privacy policy.

Accepting these terms

By installing or using Silo you agree to these terms. If you do not agree, do not use the app.

The service

Silo is an app that stores photos, videos and files in an encrypted vault on your phone. Encryption happens on your phone. Silo has no accounts. You can optionally turn on backup of the encrypted vault to your own cloud storage (see Backups below).

Licence to use

We give you a personal, non-exclusive, non-transferable, revocable licence to install and use Silo on your devices, for your own use, under these terms and the store’s standard licence agreement. Where the App Store’s Licensed Application End User License Agreement applies, it governs alongside these terms. If the two conflict, that agreement applies for the matter in conflict. We keep all rights in the app that these terms do not give you. You may not copy, sell, rent or reverse engineer the app, except where the law allows it despite this clause.

Free plan and Pro

The free plan lets you store up to 100 photos and 10 videos. Files of other kinds (such as PDFs, documents and zip files) need Pro. Pro also includes using a passphrase instead of a PIN, and the features listed for Pro in the app, which can include encrypted backup, restoring to a new phone, alternative vaults and the Emergency PIN, as they become available in the app.

If a paid plan ends, nothing is locked away. You can still view, export and delete everything you stored. Only adding items beyond the free limits stops.

Subscriptions and purchases

• Pro is offered as a weekly subscription, a yearly subscription and a one-time lifetime purchase.
• Prices are shown in the store in your local currency before you buy. The price you see in the store is the price you pay.
• The weekly and yearly subscriptions may include a free trial of 14 days. The trial is offered if you are eligible, as shown in the store. The lifetime purchase has no trial.
• Subscriptions renew automatically at the end of each period at the price shown, unless you cancel at least 24 hours before the current period ends. If you are on a free trial, you will be charged at the end of the trial unless you cancel at least 24 hours before it ends.
• Payment is charged to your Apple ID or Google Play account. We do not receive or store your payment details.
• To cancel or manage a subscription, go to the subscription settings in your store account (the App Store account settings on iPhone, or Subscriptions in Google Play on Android). Deleting the app does not cancel a subscription.
• Refunds are handled by the store, under its rules. Ask Apple or Google.
• The lifetime purchase is a one-time payment. It does not cancel an existing subscription or trial. If you bought a subscription first, you must cancel it yourself in the store.
• You can restore purchases from within the app, using the same store account.

Your PIN and recovery phrase

You are responsible for your PIN or passphrase and your recovery phrase. We cannot recover a lost phrase, reset your PIN or open your vault, because we never have your keys. If you lose both your PIN or passphrase and your recovery phrase, your data is gone, and no one can recover it. Keep your recovery phrase somewhere safe and private.

Emergency PIN

Where Silo offers an Emergency PIN, entering it on the lock screen permanently erases the vault on that phone. This cannot be undone. Any cloud backup you made stays where it is. Set it up only if you understand this.

Backups

Backup is optional. It depends on your cloud provider (Google Drive on Android, and iCloud on iOS once available), your account with them and your available storage. We are not responsible for a backup that fails or is not made because of your provider, your account, your storage or your connection. We have no access to your backup and cannot restore it for you. Check from time to time that your backup is up to date.

Acceptable use

Use Silo only for lawful purposes. Do not use it to store, hide or share content that is illegal where you live, or to harm others. You are responsible for the content you store.

Disclaimers

Silo is provided “as is” and “as available”. To the fullest extent the law allows, we give no warranties of any kind, including fitness for a particular purpose, and do not promise the app will be uninterrupted or error free. Keep copies of anything important. Nothing in these terms limits rights you have by law that cannot be limited.

Limitation of liability

To the fullest extent the law allows, we are not liable for indirect or consequential loss, or for loss of data, including data lost because you forgot your PIN and recovery phrase, used the Emergency PIN, deleted the app or lost your phone. Our total liability to you for any claim is limited to the amount you paid us for Silo in the 12 months before the claim. Nothing in these terms excludes liability that cannot be excluded by law, including for death or personal injury caused by our negligence, or for fraud. Ending these terms

You can stop using Silo at any time by deleting the app. We may suspend or end your licence if you break these terms. Clauses that by their nature should continue after the end of these terms, such as disclaimers and limits on liability, do so.

Governing law

These terms are governed by the laws of [TODO: jurisdiction]. Courts of [TODO: jurisdiction] have jurisdiction, unless your local consumer law gives you the right to bring a claim in your own country.

Changes to these terms

We may update these terms. We will change the date at the top of this page and list the change here. If you keep using Silo after a change takes effect, you accept the new terms. Where the law requires, we will ask for your agreement.
